The procedure chosen applies the “Joint Settlement” model, in accordance with Deliberation 182/02/CONS and subsequent modifications, by the Communications Regulatory Authority, in accordance with the principles outlined by the Recommendation 257/98/CE – published in the Official Gazette of the European Community L no. 115 of 17/4/1998 – and by the Recommendation 2001/310/CE – published in the Official Gazette of the European Community L no. 109 of 19/4/2001, by the Code of Electronic Communications Legislative Decree 259/2003 of 1 August 2003, the Consumer Code, the Legislative Decree 206/2005 of 6 September 2005.
Procedures
Only following the presentation of a claim which has not received a satisfactory reply, within the 30 work days provided for, WIND Clients may, without any expense, make their application for Joint Settlement, choosing to be represented by one of the Consumer Associations that have undersigned the agreement. The procedure is activated by filling out the appropriate form, with all the information and causes relative to the kind of controversy and subsequently its presentation to the settlement window. Each single application will be evaluated, case by case, by a Joint Settlement Commission that is made up of a WIND Conciliator and a Conciliator from the Association of choice.
The clients who wish to use the Joint Settlement procedure may download the application, with the attached Authorization form for the treatment of personal information, from the website otherwise they may pick it up on the premises of the Consumer Associations in the list and/or download it from the Websites of the Associations themselves. Applications must be forwarded by mail to the Wind office premises:
